1. Agreement to Terms

By accessing our website (https://failsafe.studio) or utilizing any software, desktop suites, Chrome extensions, or API services provided by FailSafe Studio, you agree to be bound by these Terms of Service.

2. Software Licenses & Commercial Usage

Each commercial license purchased for our desktop software (such as LucidWire) or extension Pro tiers (such as AetherTab Pro) grants you a revocable, non-exclusive, non-transferable license to install and execute the software in accordance with the purchased seat limit. Reverse engineering, redistribution, or cracking of license key validation endpoints is strictly prohibited.

3. Merchant of Record & Billing

All online orders and digital software licenses are processed by FailSafe Foundry (https://foundry.failsafe.studio), our Merchant of Record. Order fulfillment, invoicing, tax collection, and customer refund requests are governed by FailSafe Foundry's Terms of Sale in conjunction with FailSafe Studio's refund policy.

4. Mobile SMS & Emergency Alert Terms (Media Deadman Switch)

FailSafe Studio (FailSafe Studios) operates an automated transactional SMS dispatch and alert service for Media Deadman Switch users and their pre-designated emergency contacts. By providing your mobile telephone number and opting in via our mobile application setup screens or recipient settings, you consent to receive emergency alerts and agree to the following messaging terms:

• Program Description: Transactional SMS alerts and failsafe notifications dispatched exclusively when an end user's deadman switch timer expires without a check-in or when an alert is triggered.
• Message Frequency: Message frequency varies based on user deadman switch settings and triggered alert activity.
• Pricing & Rates: Message and data rates may apply depending on your mobile carrier and mobile service plan.
• Customer Support: For assistance, reply HELP to any message, email support at support@failsafe.studio, or visit https://failsafe.studio.
• Opt-Out & Cancellation: You can cancel SMS notifications at any time by replying STOP to any text message. Upon sending STOP, you will receive a single confirmation message confirming your unsubscription, and no further messages will be sent unless re-initiated.
• Carrier Liability Disclaimer: Mobile carriers (including but not limited to AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

5. Disclaimer of Warranties

All applications and systems are provided "as is" without warranty of any kind. While FailSafe Studio engineers every system with fault-tolerance and resilience, we are not liable for direct, indirect, or incidental damages resulting from network packet inspection, cryptographic key misplacement, or third-party service disruptions.
